1. Agreement and eligibility
These Terms form an agreement between Webdevamin, trading as Postiva, and the person or organisation using the service. You must be at least 18 and legally able to enter this agreement. If you use Postiva for an organisation, you confirm that you have authority to bind it.
Creating an account or accepting an updated version means you agree to these Terms. The Privacy Policy is acknowledged as information about data processing and is not treated as blanket consent.
A consumer acts mainly outside a trade or profession. A business customer acts for professional purposes. Customer content is material submitted to the service. Outputis AI-assisted material produced through Postiva. A subscription is recurring paid access and marketplace content is a publicly shared template. Merchant of Record means Paddle is the legal seller for the purchase and handles payment, tax, invoicing, and buyer-facing purchase obligations.
The contract is available in English and Dutch. Before checkout, you can review and correct the plan, billing period, account, and payment details. Postiva records the accepted version, language, time, and document hash. A copy of the accepted consumer information is sent by email on a durable medium. You can request another copy from support.
2. The service
Postiva turns source material into platform-ready text and media. Features can include webpage extraction, AI generation, carousels, post images, voiceovers, videos, PDF lead magnets, schedules, client approvals, API access, and a shared template marketplace. Features may change as the product develops, provided paid customers continue to receive the essential service they purchased.
3. Accounts and teams
- Provide accurate account information and keep authentication methods secure.
- You are responsible for activity through your account and API tokens.
- Team owners control membership, billing access, and workspace deletion. Admins and members receive only the permissions shown in the product.
- Ownership of a shared team must be transferred to another member before an owner can delete their personal account.
- Notify Postiva promptly about suspected unauthorised access.
4. Trial, plans, payment, and cancellation
New teams receive the trial described on the pricing page. Continued use after the trial requires a paid plan. Plan limits, billing intervals, and tax-inclusive prices are shown before checkout.
Paddle is the Merchant of Record. The purchase transaction, payment method, tax, invoice, and applicable consumer checkout terms are handled by Paddle. Recurring subscriptions renew until cancelled. Cancellation takes effect at the end of the paid period unless mandatory law or the checkout terms require another result.
The checkout states the subscription duration, renewal interval, plan limits, any trial and its conversion, and cancellation timing. A failed payment may cause retry, suspension, or cancellation after reasonable notice. A price change is announced in advance on a durable medium. You may cancel before the changed price takes effect.
EEA consumers generally have a statutory 14-day withdrawal right and can use the separate model withdrawal form. Starting the service during that period requires a separate express request where the law requires it. Paid access is not a blanket waiver of the withdrawal right.
5. Consumer digital-service rights
Consumers receive the mandatory rights that apply to the supply and conformity of digital services. These include timely supply, required security updates, and remedies when the service is not as agreed. Depending on the case, the remedy can be restoration of conformity, a proportionate price reduction, termination, and refund.
Postiva may materially modify a paid service only for a valid reason such as security, law, abuse prevention, interoperability, provider availability, or product improvement without extra cost. A consumer receives advance notice on a durable medium when required and can terminate without charge if a change has more than a minor negative impact. Mandatory rights to retrieve customer-created non-personal content after termination remain unaffected.
6. Your content and generated output
You keep ownership of material you submit and, as between you and Postiva, the generated output to the extent the law permits ownership. You grant Postiva a limited licence to host, copy, transform, transmit, and display the material only as needed to provide, secure, and support the service.
You confirm that you have the rights, permissions, and lawful basis needed for submitted material. You are responsible for checking generated output before using it, including accuracy, claims, disclosures, confidentiality, privacy, copyright, trade marks, advertising rules, and platform policies.
AI output is not guaranteed to be unique. Similar output may be generated for others, and model providers may impose their own technical restrictions.
7. AI transparency and human review
- Review and meaningfully control all generated text, images, audio, and video before publication.
- Do not present synthetic content as authentic where that would mislead people.
- Provide any disclosure or machine-readable marking required for deepfakes, public-interest information, or other AI-generated content.
- Do not use Postiva to imitate a real person, voice, brand, or protected style without the necessary rights.
8. Acceptable use
You may not use Postiva to:
- break the law, infringe intellectual property, violate privacy, defame, harass, threaten, deceive, or facilitate fraud;
- breach EU or other applicable sanctions or export controls, impersonate a person or business, publish deceptive advertising, or scrape data unlawfully;
- create or distribute sexual exploitation material, non-consensual intimate imagery, terrorist content, hateful abuse, malware, phishing, spam, or instructions for serious wrongdoing;
- process special-category data, criminal-offence data, children's data, or highly sensitive identity, financial, or confidential third-party records;
- bypass usage limits, probe security, scrape private areas, disrupt the service, share credentials, or resell access without written permission;
- use output as a substitute for qualified professional judgement in a high-impact decision.
9. Template marketplace and moderation
Publishing a template makes its preview and style available to other Postiva users. You grant Postiva and importing users a worldwide, non-exclusive licence to display, copy, adapt, and use the published template through Postiva. Imports become independent copies and may remain after the original is unpublished.
Only publish material you are entitled to share. Postiva may unpublish or restrict content after a report, rights claim, legal request, safety concern, or Terms violation. Reporters receive the process described on the content report page. Repeated misuse can result in account restrictions.
Moderation may use automated signals to prioritise a report, but a human makes the final restriction decision under the current process. A restriction notice identifies the relevant facts, legal or Terms ground, action, territorial scope, duration, whether automation was used, and available redress. The reporter and affected uploader are notified when contact information is available. Either may request reconsideration by replying to the decision notice.
10. Postiva rights
Postiva, its software, interface, branding, documentation, and non-customer materials belong to Webdevamin or its licensors. The service is licensed for use during the agreement. No source code, trade mark, or other ownership right is transferred.
Feedback may be used without restriction or payment, but Postiva will not publicly identify you as its source without permission.
11. Availability and changes
Postiva aims for a reliable service but may be interrupted by maintenance, providers, network events, model availability, security incidents, or causes outside reasonable control. Advance notice will be given for material planned interruptions where practical.
12. Suspension and termination
Postiva may restrict or suspend access when reasonably necessary to address non-payment, security risk, unlawful conduct, material breach, provider restrictions, or harm to other users. Where the issue can be fixed, reasonable notice and an opportunity to respond will normally be given.
You can cancel a subscription through billing settings and delete your account through profile settings. Account data remains recoverable for up to 30 days before permanent purge. Shared-team data may remain with the new owner after ownership transfer.
Before termination, an authorised user can request a private export of personal account data and content from teams they own. The export excludes other users' secrets and unrelated shared-team data. It remains available for 7 days. Immediate revocation is available for public review links, which otherwise expire by default after 30 days.
13. Warranties and liability
The service is provided with reasonable care and skill. To the fullest extent permitted by law, Postiva excludes implied warranties that are not mandatory and is not liable for indirect loss, lost profit, lost opportunity, reputational harm, or consequences of publishing unreviewed output.
For claims connected with paid service, aggregate liability is limited to the fees paid for the affected service during the 12 months before the event. This limit does not apply where prohibited, including fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
The exclusions and cap in this section apply to business customers only to the extent permitted by law. Consumer conformity, warranty, remedy, and liability rights are not restricted beyond mandatory law.
14. Law, complaints, and changes
Belgian law governs these Terms. Courts with jurisdiction in Belgium may hear disputes, but a consumer keeps any mandatory protection and forum rights available under the law of their residence.
Contact [email protected] first with the account and transaction details so a concern can be addressed directly. An unresolved Belgian consumer dispute can be submitted to the Consumer Mediation Service at consumerombudsman.be. Cross-border consumers retain the mandatory remedies and dispute channels available in their country. The discontinued EU ODR platform is not used.
Material Terms changes are dated, notified where appropriate on a durable medium, and may require renewed acceptance before continued use.
